  • January 6th is the deadline for submitting ballot propositions. A group of OSD activists are working on several proposals:
    • Revision to SDMC54.0110 which will provide an explicit exemption for "peaceful political activities" similar to the wording in trespassing laws (647e)
    • Clean Elections proposal for San Diego City offices.
  • January 7th is the 3-month anniversary of Occupy San Diego!

Like the frog in the warm pan of water (as the heat is being turned up on the burner), we (the people of the United States of America) were actually shut out of the recent discussion in Washington, DC around our civil rights as "terrorists" (with reference to the passage of the 2012 National War [euphemistically Defense] Authorization Act [NDAA], Title X, Subtitle D, Section 1031 [a-e]), when President George W. Bush signed into law the "Authorization to Use Military Force Against Terrorists" (Public Law 107-40, 115 Stat. 224 [2001], AUMF-I) on September 18, 2001 (remember his "You're either with us [the 1%], or your with the enemy [the 99%]" along with his "The Constitution is just a god-dammed piece of paper" - interestingly, AUMF-I was signed over one year before the "Authorization to Use Military Force Against Iraq" [AUMF-II], which provides a bit of a hint as to what was (is) really going on behind the scenes - for deep background you need to go back to then War (euphemistically, "Defense") Secretary Dick Cheney's writings from 1992 [brought up to date and published as "Rebuilding America's Defense: Strategy, Forces and Resources" by the Project for the New American Century {PNAC} in 2000]). Remember the Bush administration cited AUMF-I in the court battle over its expansion in the NSA's warrantless eavesdropping on US citizens' phone calls, internet usage, and emails.

As Constitutional lawyers, Glenn Greenwald and Johnathan Turley have pointed out, President Obama was not concerned with the constitutional rights / civil liberties of US citizens when he treatened to veto the NDAA, rather he was threatened in that Congress had written provisions to codify the detaining of suspected "terrorists" and President Obama did not want to have to follow Congressional rules when he chose to deal with persons he suspected of being a "terrorist." Can you say, "Unitary Executive"?

Take a moment to reflect on this, as a United States citizen, you are now subject to not only being indefinitely detained - without due process, that is to say, without notice, without a hearing, without charges, without a lawyer, without a trial - but also murdered (two cases in point, the murders of New Mexico-born Islam cleric, Anwar al-Awlaki and the Pakistani American editor of Insight magazine, Samir ibn Zafir Kahn).

For our political class, and the private-sector the owns it (the 1%), the War on Terror - Endless War - is not a means to an end, but is the end itself!

Kudos to the people of the State of Montana in starting the recall process of their senators who voted for the NDAA with Title X, Subtitle D, Section 1031 [a-e] intact. Hopefully, someone in the State of California will propose a law to the legislature to amend the state's constitution to allow recall of elected Senators and Congressmen for violating their oath of office, to protect and defend the United States Constitution. Such a recall movement may be our last best hope of restoring Constitutional rule of law to America.

Another hope would be to get active with movetoamend.org and limit the power of the 1% and their method of "one dollar, one vote" to control the lives of the 99%!

  • Police Raid on General Assembly in San Diego Dec 29 During the daily scheduled General Assembly at Freedom Plaza, SDPD officers swarm the protesters involved in GA and make two arrests. GA disrupted police refuse to explain why. Protesters respond by reading the police the declaration of the occupation and resuming GA.

  • Pepper-Spray Officer Involved in Nine Lawsuits, Including $30,000 Settlement Anthony Bologna, the senior police officer who was videotaped using pepper spray on the eyes of protesters, was previously named in a lawsuit alleging police brutality at the 2004 protests of the Republican national convention. The Local has now acquired court documents, some of which are posted below, that show it is just one of nine lawsuits in which the officer is named, all of them alleging the violation of demonstrators’ constitutional rights.

    • Occupy Greyhound Update: OSD to Occupy Greyhound to OD.C. to be part of the 1 million tent protest. We are leaving on the 13th and returning in SD on the 25th. We have 12 people going and we were able to purchase 8 tickets from donations. We will still be collecting donations for the use of going to some tourist attractions while we are in DC as a group, in matching Occupy San Diego clothing hopefully. We are also working on getting a hold of all the local media stations so when we stop there should be coverage of our trip (hopefully). We are going to get with education committee to see if there can be some classes to make sure everyone is up to speed on all the important issues currently infesting our world. I am very thankful for all the support we have received from the community of people that could not go but wanted to see this trip become a reality.   • 26 Jan 2012 - (7p) - Voices of a Peoples History event at SanDiegoCityCollege - Saville Theater. This is the 100th anniversary of the San Diego Free Speech Fight, when city coucil prohibited soapbox oration centered at Fifth and E streets in the Stingaree Distrcit (Gaslamp). Prosecutors charged those arrested on felony charges of conspiracy, and police brutality was common. The Free Speech League sought to bring the cases up to jury trials to clog the system. There were an estimate of 5,000 involved in one protest, with 41 arrested. The views of the Free Speech movement were similar to Occupy, both on the wealth divide, and later on, First Amendment rights. The circumstances of the movement are echoed today. Vigilantes would take Wobblies trying to go south to San Diego off the trains.
