Part 1

This part includes the analysis of LAFCO legal counsel regarding whether El Cajon Mayor Mark Lewis could be included in the closed session regarding the litigation between the City of El Cajon and LAFCO. It is the position of COPS that this closed session was improper because the litigation is completed. Also, it is our opinion that Mark Lewis should have recused himself and not voted on this issue. Instead he seconded the motion.

After the closed session, public comment on item #10 was processed and a vote taken, 5-3 to comply with the judgment. The body did not document the vote until it was requested by Citizens Oversight representative Ray Lutz. Such a vote on an important issue should be taken by roll call. It is quite surprising to see them try to sneak this vote through without documenting who voted for and against it.

Part 2

In this part, LAFCO submitted a budget with last minute adjustments, and the item was continued. Intense scrutiny should be given to this budget as it appears it is growing year by year. After the vote on the budget (#9), the body took up the issue of relocation, which was not included on the agenda, and therefore inappropriate per provisions of the Brown Act. Ray Lutz attempted to speak on the issue, but the meeting was adjourned without allowing him to speak, another Brown Act violation. The body did not have a formal vote, but with heads nodding, decided to form a subcommittee to study the relocation issue.
