Two relevant ballot proposals were put before the Rules Committee of the San Diego City Council. They listened but did nothing.

Josephine speech/email to City Council

I have emailed members of the City Council several times and have never received a reply from any of you or your assistants. I feel this was important enough to speak to you in person.

First, briefly about Occupy San Diego. It has undergone changes at the Civic Center after the first raid when the tents were removed. OSD thereafter complied by not erecting any tents. Then they were told they could sleep along Third Avenue in the grass, which was actually mud.

After being relegated to that area, another raid happened and arrests occurred again. I understand that many people that have been arrested have not had charges filed yet. The DA can take up to a year to file. People are in a state of limbo with regard to their case.

Since the last time I spoke to City Council regarding the violation of First Amendment rights and the potential of the City to be involved with civil litigation, there continues to be numerous arrests at Civic Center.

I'd like the City Council to be aware of some of these arrests because the nature of them troubles me.

Ray Lutz was arrested for setting up a registration table. Over the years, many tables have been set up at the Civic Center to register voters, particularly the recently naturalized citizens. But suddenly, this was not permitted and Ray was in jail for several hours. I discovered yesterday that no charges have been filed yet. Another case that remains in limbo.

Many people were arrested for illegal lodging. As the City Council is aware, homelessness is an issue in San Diego and it is NOT a crime to be homeless. There was case law that required that police offer a bed at an available shelter and that person must decline it before the individual can be arrested. In fact, I think the person must be cited multiple times within so many days before that person is arrested. Judge Mc Curine signed this order. Beds at shelters are very few and limited.

The police have decided to basically be in contempt of court and violate that order. In order to enforce that order, we would need to locate the original plaintiff in that case, is my understanding. Therefore, the police with impunity have completely ignored that order and have been arresting people for illegal lodging.

One evening the police came while some protester were awake, but 2 were laying down, one asleep. The protesters reminded the police of the court's ruling and one man, Chris Mc Kay was videotaping the incident, as he has a right to do. The police grabbed him by the neck in a choke-hold and arrested him and the others.

Now anyone who wishes to remain at Civic Center is subject to sleep deprivation. Meanwhile, in several parts of this City, there continue to be tents and homeless people sleeping and the police do not do anything.

Other incidences which have occurred at Civic Center which I found outrageous was when the police confiscated a United States flag from a Veteran because the pole was a quarter-inch too big. This flag was at Civic Center for 2 months and attended to by various veterans. However, I also saw video footage of some religious people at Third and C, just a block away, with signs on poles that were even larger. Police did not confiscate those poles.

On the day of winter solstice, someone was burning a twig of sage at Civic Center. That person was arrested. I'd like the City Council to know that numerous times while at Ocean Beach and Pacific Beach, I have smelled sage burning and seen it in plain sight. This is very common. Not one time have I seen anyone get a ticket for it, much less get arrested, despite routine police presence.

On Christmas day, someone dropped off a Christmas tree at Civic Center and the police must have felt that was a danger to citizens and applied the Municipal Code 54.0110. The tree was quickly removed.

As to the subject at hand of the Municipal Code 54.0110, the encroachment, this infraction has allowed police to use their discretion when enforcing the law. Rather than merely writing citations for this ordinance, SDPD has choosen to arrest citizens.

One incident was right in the middle of a General Assembly meeting, the police came and intentionally disrupted the meeting by arresting 2 people, one for having a sign and backpack on the railing of the staircase.

Another particular incident comes to mind when Mike Garcia was sitting in a folding chair handing out literature about freedom of speech. Police arrested him and he did not have the funds for bail, so he remained in jail.

The media has mentioned that the City has spent a considerable amount of money on police because of Occupy. However, in reviewing the arrests, I do not place the blame on Occupy. I place the blame on whoever has given the orders to the police.

Occupiers of this movement have many times come to this City Council requesting approval of a resolution. A man even endured a hunger strike and was ignored by City Council, oh, and he was also arrested when he fell asleep at the plaza.

All of these arrests could have been avoided and the City of San Diego could have saved a considerable amount of money, not to mention litigation, if a resolution had been passed.

As a citizen and taxpayer, I am appalled at the amount of money this City has spent on police to basically watch over peaceful protesters.

And quite honestly, at this point I am certain that all these actions have been to harrass and suppress the peaceful protesters who are exercising their right to free speech, directly violating Title 18, U.S.C. Section 241

The police have selectively targeted Occupy in each instance, the tents, the illegal lodging, the burning of sage, the pole size of the U.S. flag, the registration table, the folding chair, etc.

I am certain that these arrests are occurring to stifle free speech. When I attended previous City Council meetings, I understood that the members of this council were respecting free speech rights. I think it was Mr. Young who said the City Council had no intention of violating people's First Amendment Constitutional Rights of free speech and peaceful assembly. In my opinion, the City Council, by not approving a resolution, have acted as silent accomplices to every arrest at Civic Center.

Now I urge the Rules Committee to immediately approve and amend Municipal Code Section 54.0110 to prevent further frivolous arrests.
