the official position of Occupy San Diego, but is
compiled for the use of supporters and occupiers
by a number of volunteers.

NEWS

  • Temporary Restraining Order DENIED
    • Judge William Hayes rules against the temporary restraining order filed by Occupiers in Federal Court.
      • Full Ruling: http://on.fb.me/uU9kWF
      • This decision is surprising in that it says the SDMC 54.0110 is "narrowly drawn".
  • Tables Return to Freedom Plaza
    • The day after Raymond Lutz is arrested while registering voters Occupiers return with tables and voter registration cards to engage in peaceful political activity as is their Constitutional right
    • SDPD tell Occupiers while voter registration is allowed putting tables down is not and threaten to arrest anyone who does so.
    • Occupiers were still registering voters at a table throughout the day and night at Civic Center
  • Raymond Lutz arrested!
    • Lutz arrested while engaging in the peaceful political activity of voter registration at Civic Center Plaza.
    • Owner/Operators of Civic Center Office Building include Goldman Sachs, hedge funds and Wall St. Banks -- a who's who of the criminal banking industry 0.1%
    • Ray Lutz has filed a lawsuit against the owners and operators of the Civic Center Plaza building, that invoked the citizens arrest.
      • Press conference held Nov 30 at 5pm to announce the lawsuit.
      • Attorney Michael Aguirre will handle the case on contingency basis, but we still will need to fund-raise for court costs and fees, for war chest and defense fund.
      • Fundraising will be set up shortly separate from OSD funds.
      • I daresay they will be very sorry they stepped over this line.
      • Read the text of the complaint by Lutz against CBRE
    • The ACLU is considering taking up a case to test Pruneyard for the case like what we have in San Diego: The public square where part of it is owned by a private party, and the fact that voters who were registering were not allowed to complete their registrations.
  • Yet Another Arrest at Freedom Square
    • Occupier Curtis Williams AKA "Hex" arrested for the unbelievable crime of tearing caution tape early Wednesday morning.
  • Hunger Strike -- John Kenney continues his hunger strike, now in day 24. He is requesting that the City come to the table and discuss the right of Occupy San Diego to conduct protests in the form of an encampment. John is now sick and I am starting to worry about his health.
    • Need to get a wheelchair for John at this point as he is feeling weak. Any donations?
  • Jury Trial for Randy Wolling, AKA "Sage" -- Jury is now deliberating.
    • Sage was sitting on the sidewalk after the second raid. He is charged with impeding an officer, and illegal assembly.
    • He has been in jail since Oct 28, over a month due to two other previous charges outstanding: meditating on Blacks Beach and being on Blacks Beach before 6am.
    • I can't believe they are wasting their time and money on this. No wonder our government is low on money.

Despite what you might hear on the corporate-owned news:
  • The occupation continues, around the clock.
  • PLEASE COME DOWN when you can and help with numbers. This is your true vote. Stay at home = vote against 99%.
  • Tents and almost everything is now being restricted by the police.
  • Food is needed -- we no longer have a food table, so you'll have to play it by ear.
  • We will not be denied our constitutional right to assemble and speak!
  • Many Teach-ins on Sunday!

Court Hearing
Federal court hearing of the TRO (Temporary Restraining Order) regarding Municipal Code 54.0110. Judge Hayes heard the oral arguments at 2:30pm on Tuesday, Nov 22.
  • NEW Decision was reached on Dec 1. Judge DENIED TRO
  • Court Documents -- Full Ruling
  • Attorney Bryan Pease could not attend in person because he just completed Lasik eye surgery. He attended by telephone but did not participate in the hearing.
  • Attorney Todd Cardiff presented the arguments in favor of the restraining order.
    • The primary argument is that the law is vague and overly broad, and therefore subject to abuse. It outlaws anything on public property, even a coffee cup, and even if it is for free speech.
    • We are talking about the civic center plaza here, which is specifically set aside for free speech.
    • Quoted ACLU vs. City of Las Vegas
  • Asst City Attorney Kristin Black presented the defense for the City.
    • Said TRO is not required, because there is no imminent harm. She said the protests have been continuing with out disruption since Oct 7 and there is no infringement of freedom of speech. If this was a big concern, then this case should have been brought sooner.
    • She said that the law was only used when the plaza was cleared, because they did not want the protestors setting up their tents and gear while the square was being cleared. Of course we know this statement was far from being accurate.
    • She said they have not "precluded anyone from putting anything down." Maybe, but I know once it is put down, the police will threaten arrest if you don't pick it up.
  • Judge said he would consider all the arguments and release a written decision. Normally, these don't take very long.
  • If this Temporary Restraining Order is approved, we will return!
  • Attorney Todd Cardiff said he will be preparing an additional declaration regarding the impossibility of siting a voter registration table in the public portion of the plaza.
  • We STILL need video documentation of police hassling people about setting stuff down. If you have such a video, please contact us at osd-feedback@citizensoversight.org so I can get it to the right people.

I went down last night [Nov 28] concerned that there would be pepper spray and particularly when I saw the police cars parked a block away and then the amount of police on duty! Then the crowd. Then I got up inside the crowd and there were these wonderful little tents! It was brilliant. I saw Mike Garcia in a suit (upgrading the face of Occupy) and being articulate being interviewed by KUSI. The whole idea was brilliant. This is the kind of creativity that is going to keep Occupy growing.

It is important that Occupy present the most respectful face possible toward the use of the Civic Center and not create a huge mess that can be used as a focus to downgrade the real issues: JOBS NOT CUTS MAKE WALL STREET PAY

The homeless paraphernalia in the middle of Civic Center is unsightly. On the other hand it is such a travesty that SD has 9,000 homeless and growing. We could actually embrace the spectacle and acknowledge they are of the 99%. And more coming if Soc. Sec. and medicare are cut.

The smoking in the crowd is ongoing and unpleasant. (choke choke) I may take on posting little signs: Thank you for not smoking in the crowd. Cans of sands are needed to handle the butts.

When I arrived on Sunday there was a HUGE pile of TRASH accumulated on the sidewalk. The story was that "the CITY wouldn't pick it up." The Women of Occupy SD were meeting. I asked among our group if anyone had a truck. A call was made to someone's friend in Ramona. Within the hour the trash was being loaded. We can encourage people to provide plastic bags and haul away a bag of trash when they come down.

Things are getting done and I do not know who to thank. This leaderless movement is fluid and wonderful. With no specific strategies, it is more difficult for the adversaries to mount a counter strategy. They do not know what to do with it. And it impresses the point that this is Americans across the country not an organization. I think that makes it scarier to them. Who do they wiretap?

Removing money from BIG banks and giving jobs to Americans by shopping for American made products this Christmas are things that are make a difference right NOW. A list of companies that employ Americans and do not outsource would be useful to post.

Technology makes it possible for us to act in unison across the nation. That makes an impact. It is SEEN and it is FELT. Gets them where they live--in their pockets. Maybe we will see the end of war. What a lot of money that will free up and what a lot of suffering will be spared the wounded and the friends and families of the lost and/or wounded. I have hope through the next generation.

  • Occupy SF faces deadline to pack up tents Occupy San Francisco members are bracing for a possible raid after city officials told them they had to pack up their tents in the financial district and move to a new site provided by the city by Thursday.

  • Fed bailing out the Euro A surprising (if you don't want to say secretive) meeting of the world's most influential central bankers produced even more surprising results. The US Central bank – the Federal Reserve – promised the cash-strained European Central bank a practically unlimited amount of American taxpayer money for cheap, effectively bailing out the Euro.
