  • MORE ARRESTS!
    • After a reduced police presence all weekend, the SDPD regrouped and once again raided Freedom Plaza in the early morning hours
    • Nine Occupiers Arrested
    • Fish -- out on bail and back at Freedom Plaza
    • Sarah -- Sarah identifies as a woman but has been put in the mens lockup. She was arrested early in the AM of 12/5/11 for illegal lodging while participating in the Occupy San Diego protest. Please share and contact Tracey Reardon Odman if you can help with bail. We are coordinating donations for her at the Civic Center now! https://www.facebook.com/tracey.odman
    • Claudia Acevedon -- arrested last night supposedly for illegal lodging. She is being held in ICE because of her immigration status.
    • More Information will be posted as received.
  • * OSD Freedom Square GA Changes consensed to on Sunday
    • The People's Mic will be used for Introductions to GA, Committee Announcements,
and Proposals. Individuals may opt out of using the People's Mic only for committee announcements.
    • From December 17th, GA's on Saturday will begin at 2pm.
  • Jury Trial for Randy Wolling, AKA "Sage" -- HUNG JURY.
    • Now awaiting DA's City Attorney decision on whether to retry the case all over again!
    • Sage was sitting on the sidewalk after the second raid. He is charged with impeding an officer, and illegal assembly.
    • He has been in jail since Oct 28, over a month due to two other previous charges outstanding: meditating on Blacks Beach and being on Blacks Beach before 6am.
    • The SD Sheriff Who's In Jail website lists his next court date as Dec. 6 at 1:30 pm
    • I can't believe they are wasting their time and money on this. No wonder our government is low on money.
    • Any more details would be appreciated
  • Hunger Strike -- John Kenney continues his hunger strike, now in day 25. He is requesting that the City come to the table and discuss the right of Occupy San Diego to conduct protests in the form of an encampment. John is now sick and I am starting to worry about his health.
    • John now has a wheelchair to help him get around, as at this point as he is feeling weak.
    • Join John and many of your fellow occupiers at the City Council meeting on Tuesday December 6 at 10 AM as we once again try to get Occupy San Diego on the agenda.
    • This will be the fifth time we try to have five members of the council to agree to just put on the agenda a resolution allowing us to occupy Freedom Square or another secured area. We also have four other proposed resolutions: on foreclosures, amendment to regulate & end "corporate personhood", getting money out of politics, and opposing the of the National Defense Authorization Act (NDAA) as recently passed by the Senate which would allow the military to detain US citizens arrested within the borders of the United States indefinitely.
    • Meet on Monday, December 5th at 4:30 PM to strategize how to best effectively use the three minute per item rule during non agenda comments.
  • Get the word out
    • We have several events that we need you to attend as well as help in promoting, including the Candlelight Vigil & Silent March for the Unemployed on December 8, the the West Coast Port Shutdown on December 12, and the Occupy SD benefit concert at The Ruby Room on December 14.
    • Tell your friends either in person, through tweeting a link on Twitter (remember to include #osd, #occupysandiego, and/or #occupysd), confirm you are attending on a Facebook event, reblog on Tumblr, or just print out some flyers and pass them out to your friends, loved-ones, acquaintances, as well as those who will soon fall into one of those categories once you give them a flyer.

Despite what you might hear on the corporate-owned news:
  • The occupation continues, around the clock.
  • PLEASE COME DOWN when you can and help with numbers. This is your true vote. Stay at home = vote against 99%.
  • Tents and almost everything is now being restricted by the police.
  • Food is needed -- we no longer have a food table, so you'll have to play it by ear.
  • We will not be denied our constitutional right to assemble and speak!
  • Many Teach-ins on Sunday!

Legal Actions
* (Temporary Restraining Order Federal court hearing of the TRO (Temporary Restraining Order) regarding Municipal Code 54.0110. Judge Hayes heard the oral arguments at 2:30pm on Tuesday, Nov 22.
  • NEW Decision was reached on Dec 1. Judge DENIED TRO
  • Court Documents -- Full Ruling
  • Attorney Bryan Pease could not attend in person because he just completed Lasik eye surgery. He attended by telephone but did not participate in the hearing.
  • Attorney Todd Cardiff presented the arguments in favor of the restraining order.
    • The primary argument is that the law is vague and overly broad, and therefore subject to abuse. It outlaws anything on public property, even a coffee cup, and even if it is for free speech.
    • We are talking about the civic center plaza here, which is specifically set aside for free speech.
    • Quoted ACLU vs. City of Las Vegas
  • Asst City Attorney Kristin Black presented the defense for the City.
    • Said TRO is not required, because there is no imminent harm. She said the protests have been continuing with out disruption since Oct 7 and there is no infringement of freedom of speech. If this was a big concern, then this case should have been brought sooner.
    • She said that the law was only used when the plaza was cleared, because they did not want the protestors setting up their tents and gear while the square was being cleared. Of course we know this statement was far from being accurate.
    • She said they have not "precluded anyone from putting anything down." Maybe, but I know once it is put down, the police will threaten arrest if you don't pick it up.
  • Judge said he would consider all the arguments and release a written decision. Normally, these don't take very long.
  • If this Temporary Restraining Order is approved, we will return!
  • Attorney Todd Cardiff said he will be preparing an additional declaration regarding the impossibility of siting a voter registration table in the public portion of the plaza.
  • We STILL need video documentation of police hassling people about setting stuff down. If you have such a video, please contact us at osd-feedback@citizensoversight.org so I can get it to the right people.

  • Lutz suing Civic Center Plaza building owners and operators
    • Lutz arrested while engaging in the peaceful political activity of voter registration at Civic Center Plaza.
    • Owner/Operators of Civic Center Office Building include Goldman Sachs, hedge funds and Wall St. Banks -- a who's who of the criminal banking industry 0.1%
    • Ray Lutz has filed a lawsuit against the owners and operators of the Civic Center Plaza building, that invoked the citizens arrest.
      • Press conference held Nov 30 at 5pm to announce the lawsuit.
      • Attorney Michael Aguirre will handle the case on contingency basis, but we still will need to fund-raise for court costs and fees, for war chest and defense fund.
      • Fundraising will be set up shortly separate from OSD funds.
      • I daresay they will be very sorry they stepped over this line.

    • The ACLU is considering taking up a case to test Pruneyard for the case like what we have in San Diego: The public square where part of it is owned by a private party, and the fact that voters who were registering were not allowed to complete their registrations.

  • [Los Angeles Stands Up To The Supreme Court, Looks To Revoke Corporate Personhood Billions of corporate dollars have poured into the 2012 Election, all thanks to the Citizens United decision by the conservative members of the Supreme Court. Towns and counties across the country have proposed or passed resolutions against corporate personhood, the most recent of which is Missoula, Montana. But now a major city in America looks to do the same next week.

  • Alan Grayson on GAO Report on the Fed For the first 96 years of the Fed’s existence, the Fed’s primary market activities were to buy or sell U.S. Treasury bonds (to change the money supply), and to lend at the “discount window.” Neither of these activities permitted the Fed to play favorites. But the programs that the GAO audited are fundamentally different. They allowed the Fed to choose winners and losers. I’ve called the GAO report a bailout autopsy. But it’s an autopsy of the undead.

  • Texas Senators Vote to Legalize Sex with Animals in National Defense Authorization Act The National Defense Authorization Act includes a provision to repeal Article 125 of the Uniform Code of Military Justice (UCMJ). It states: "(a) Any person subject to this chapter who engages in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration, however slight, is sufficient to complete the offense. (b) Any person found guilty of sodomy shall be punished as a court-martial may direct.”

  • Police raid Occupy Boston and arrest…the sink?] The city and the police have been on our case for weeks. We’re supposedly unclean. Our dishes are not getting clean enough. So, somebody figured they’d get us a new sink. But the police ARRESTED OUR SINK. They literally took it from us by force, threw it in the back of a prisoner wagon, and sped away.

  • InterOccupy.org provides channels of communications between GAs, Work Groups and Occupiers across the Occupy movement. We are currently hosting several weekly conference calls that connect occupiers with shared interests. Our General Call is every Monday night.

  • Zuccotti Park owners Brookfield Properties owe city $139G in back taxes The city Finance Department says park owner Brookfield Properties and its parent company, Brookfield US Corp., currently owe the city more than $139,000 in unpaid business taxes from 2006, 2007, 2008 and 2009.
    Brookfield is among 40,000 entities that owe the city an eye-popping $149 million in overdue business taxes dating to 2000, the Finance Department says.

  • Freeze Flash Mob & Police Brutality - Don't Buy War Code Pink Austin, along with allies from Veteran's for Peace and Women in Black staged a Don't Buy War "freeze" at Barton Creek Mall on Saturday, December 3rd. All was peaceful until mall security and APD arrived, and an APD officer brutally attacked a young woman who had joined the group spontaneously
