CITY COUNCIL MEETING
- Agenda item commemorating 100 year anniversary of Free speech fights of 1912 will allow us to talk about free speech violations happening today.
- Note that since this is on the agenda, any number of speakers can take part.
- Also public comment shortly thereafter.

Encroachment Law Temporary Restraining Order (TRO) Hearing
- The first hearing was a "facial" challenge, which was denied. This on is about the actual violations, the as-applied challenge to section 54.0110.
- Hearing is this Thursday at 9:30am in federal court before Judge Hayes
- Location is: 880 Front St, Courtroom 4.
- Would be cool if plaintiffs can attend and sit up at the plaintiff's table with me, and supporters in the courtroom as well.
San Onofre Nuclear Generating Station (SONGS)
- This nuclear plant had generators replaced a VERY SHORT time ago, and they are already wearing out.
- We still don't know the full extent of the failure because the authorities, and all Main-stream media do not tell the truth. MSNBC is owned by GE and CBS is largely owned by Westinghouse, and those two companies both make $$ from selling nuclear plant hardware.
- OSD should consider working with LA Occupy and other environmental groups to shine a light on this. So far, groups are talking about Feb. 18 or 19, or 2/25 or 2/26.

- Jury Trial of Benjamin Gasper, who despite our state's law allowing for medical marijuana cultivation for personal use, has been targeted by San Diego's District Attorney Bonnie Dumanis. This trial will be indicative of how Dumanis operates and bends the law to interpret simple cultivation to automatically infer cultivation for sales. - (6p) This will be the 100th anniversary of the first of the Wobbly arrests in the San Diego Free Speech Fight, for exercising their right to free speech in San Diego. The San Diego and Imperial Counties Labor Council will have a commemoration at 5th Ave. and E Street, featuring music, performances, special guests and people speaking from soapboxes as they did in 1912.

I found out today from Marti Emerald's chief of staff that tomorrow a proclamation commemorating and basically "apologizing" for what happened 100 years ago in regard to suppression of free speech will be presented to ACLU at City Council meeting (see attached).
This is extremely important in light of the current suppression of free speech at Civic Center. Unfortunately, I have a dr appointment tomorrow and cannot be there, but I highly encourage others to go early and ask to speak to this "agenda" item and see if they will allow comment. I also highly suggest that the comments be civil and thank the Mayor especially for signing this document but with an added BIG BUT that we need another proclamation that addresses the suppression of free speech and arrests and violence against those who have spoken out at Civic Center since October 7, 2011.
I spoke to Martha Sullivan this morning and she wonders if now is the time to introduce a proclamation or resolution calling for an amendment to the City’s municipal code to improve the respect of free speech in San Diego. This amendment will create an explicit exception to the current encroachment law (SDMC 54.0110) to allow for “peaceful picketing, lawful labor activities and peaceful political activities."
If you read the proclamation as written for today, it definiely lends itself to this and only needs to be updated to cover what has happened at the Civic Center with an apology and perhaps all the arrests need to be voided and money reimbursed for bail bonds that were paid out and most of the charges dropped. I hope that all of this can be presented in a civil and positive manner and rather than applause -- ask those present to stand in support of another proclamation or amendment. If they do not allow public comment on a proclamation agenda item, then sign up for non-agenda. Would be especially appropriate for anyone arrested in regard to free speech to speak.
There will also be an event in commemoration of the event and proclamation on Feb 8 @ 6pm at 5th & E by the SD Labor Council. Is anyone attending?

Hi All:
The very recent and ongoing leaks at the San Onofre Nuclear Power Plant and the danger this plant poses for major metropolitan populations both North and South of the plant continue to be very serious.
The lesson of the disaster at the Fukushima power plant, also sitting on a coastline and adjacent to tectonic faultlines is all too similar to be dismissed. This nightmare could be ours!
I am suggesting a combined San Diego/Los Angeles Occupy Action at San Onofre as soon as possible so that pressure could be put on the public and private interests that want the plant to continue to operate.
Buses could be used to carry demonstrators to the site. I believe a combined San Diego/L.A. action would make a powerful statement here in California and broaden the scope of Occupy nationwide.
There could be voluntary contributions from the Occupy community at large for those who cannot pay the bus fare to San Onofre.
The implications of the San Onofre Nuclear Power Plant presence right here on our coastline is hard to wrap our heads around. We all know the absurdity of any civil defense “ evacuation plans.”!
All the more reason that we need to face the unthinkable and take action quickly! perhaps Saturday or Sunday Feb. 18 or 19, or 2/25 or 2/26

- It usually takes about 6 hours for someone who has been arrested to pop up here. This site will tell you their charges, bail, etc. Jail's number is (619) 615-2700. The jail won't tell you much if anything that is not on the website. Please check this website before saying someone is in or out of jail to avoid confusion.
- FYI -- Penal Code 849.5. In any case in which a person is arrested and released and no accusatory pleading is filed charging him with an offense, any record of arrest of the person shall include a record of release. Thereafter, the arrest shall not be deemed an arrest, but a detention only.
