NEWS

M11_San_Onofre_Flier-1up-fmclip.png Details: M 11 San Onofre Protest And Rally

OSD Forks
  • There are two groups meeting which are forks from the original OSD.
  • Freedom Plaza had a good turnout at the recent GA on Saturday, 47 people, a bit increase from last weeks 8-10 people.
  • Childrens Park has had a consistently larger group of about 40 people or more.
  • This email blast does not play favorites and will try to provide information on both forks, and other non OSD events too.
  • Please check meeting locations carefully as previous information may be incorrect.
  • NEW See message from "Anonymous" here: http://pastebin.com/mSyPTXqg

GA at CP
  • Had about 50 people in attendance.
  • Approved a proposal to separate finance committee work from Activist San Diego, as apparently Pat Barnes is no longer working for ASD, and there is some $7,000 discrepancy in the books, according to ASD.
  • There was some discussion about what to do next, and this was put in the hands of the Finance Committee.
  • Broached the topic of United GA, which would meet for the first time on March 17 at 4pm PST and 7pm EST, and would provide a way for all GAs across the country to at least be discussing the same topic at the same time. This sounds very promising. Proposal will continue to be discussed for the next several GAs.

Occupy Walk They had a wonderful day today. A doctor stopped them in Temecula, gave them $50 and spoke about Obama care, they met a real sheep herder from Peru, and a passing car saw their signs, looked them up on the computer- liked what they saw and came back with food and drinks. And her kids made them signs. A beautiful [place] to camp for the night. You know Ray, these guys just might make it.

the Walk Across America walkers are in desperate need of donations for food. Please donate to their we pay account if possible. This is an action very dear to my heart, and yes- I am begging. No amount is too small, every dollar provides nutrition for the walkers or a camp site. I am handling their tracking of expenses and it is all very transparent on their website, we account for every penny spent. Even if you don't know the walkers, do it for Nan, please. I have dished out favors my entire life, now is my turn to ask for one. I don't even mind begging for one. I will return the favor in any way I possibly can.

San Onofre Nuclear Generating Station (SONGS)
  • NEW OSD at Children's Park endorsed!
  • Press Release on M11 San Onofre Protest sent to media and all lists Monday.
  • Contacted by KPFA -- They want to run our livestream along with many other protests happening on March 11 regarding the Fukushima disaster.
  • NEW Women from Fukushima have been confirmed for this event. This will make it extremely newsworthy -- you don't get visitors from Japan to tell their story very often.
  • Fliers and posters are in hand! Please email osd-feedback@citizensoversight.org if you can help distribute flyers and put up posters.
  • Will be meeting with San Onofre State Park rangers and SONGS security Wednesday, 2-29 to insure that our event is safe and effective.

Legal Hearings, etc.
  • Jury trial of Curtis Williams, aka Hex, is continuing in Dept 15 of San Diego Superior Court Wednesday, February 29, with defense starting their case promptly at 9am.
    • Hex was arrested during the Port Shutdown protest for crossing the street and faces a misdemeanor charge of Penal Code 148, resisting arrest or delaying/obstructing a peace officer.
    • I (Ray Lutz) was able to attend much of the state's case against Hex. Apparently, Hex was walking across the street at the corner, where there was no crosswalk marked, so it is considered J-walking. Some traffic was backed up due to the protest action. The San Diego Harbor Police were handling the situation, and they described early on Tuesday how they monitored the Facebook page to determine what they would do in advance of the event (which Mitchell Sterling described to me). One officer was told by his superior to announce to the protesters that they were an unlawful assembly, but even though there were blanks in the form he read from where they would normally specify the laws supporting the announcement that it was a illegal assembly, he did not cite any laws. According to defense witnesses to be heard on Wednesday, they will say they did not hear any announcement and that Hex did not say he would not comply.
    • The defense attorney attempted to have the case dismissed because the primary reason the police said Hex was "delaying or obstructing a peace officer" was because they were busy arresting him. Amazingly, Judge Shore said a reasonable jury could find Hex guilty of obstructing an officer even though the reason he was "delaying" the officer was because the officer decided to arrest him. This rates right up there with the other ridiculous arrests, and is a complete waste of everyone's time.
    • Come occupy the court in support of a committed member of this movement, and stand against the continuous civil rights violations of San Diego law enforcement and the City Attorney's persecution of an innocent man. We had a good turnout on Tuesday and we need to do the same on Wednesday.
    • Check the Facebook event for updates and to RSVP. The downtown criminal courthouse is located at 220 W. Broadway.
  • Benjamin Gasper's trial has been postponed to allow the defense to respond to new evidence brought forth by the prosecution. The newest court date is March 19th at 9:30 in department 50.

Media: Occupy San Diego

Media: Occupy National and Global

  • Tennessee Legislature Takes On Occupy Nashville! The Tennessee Legislature today passed a piece of legislation which is specifically, and uniquely purposed to disband Occupy Nashville, and to remove it from the one place of guaranteed free speech in our State. The Tennessee Legislature today passed the "Anti-Occupy" Bill, HB2638.

  • How The Gas Prices Are Manipulated By The Koch Brothers And Other Wall Street Players One of those players is the petrochemical multinational Koch Industries. Although oil extraction is a small part of the Koch’s oil business the company has major control over every other part of the market as its core venture is shipping crude oil, refining it, distributing it to retailers, then speculating on the future price. The company actively trades about 50 types of crude oil around the world and has trading operations in London, Geneva, Singapore, Houston, New York, Wichita, Rotterdam, and Mumbai.
When future oil prices are expected to rise–which means when demand is expected to exceed supply–big banks and companies like Koch start buying up oil and storing it in massive containers both on land and offshore to lock in the oil for sale later at a set price.

  • What is #M1GS? In most European countries, May 1st is traditionally a ‘Workers’ day – a day of Labor Solidarity, and a public holiday. In Los Angeles, it’s a day to celebrate and march in support of im/migrant rights. In protest against the corruption of the worldwide marketplace, which has led to illegal foreclosures, mass unemployment, low wages, high taxes and a penalization of all those who do not own the ‘99%’ of the world’s resources, and in solidarity with the im/migrant movements of May 1st, OLA decided to declare May 1st, 2012 a People’s General Strike. Instead of calling upon unionized Labor to make a specific demand (illegal under Taft-Hartley), OLA is calling upon the people of Los Angeles and the United States of America to take this day away from school and the workplace, so that their absence makes their displeasure with this corrupt system be known.

  • Goodbye, First Amendment: ‘Trespass Bill’ will make protest illegal The US House of Representatives voted 388-to-3 in favor of H.R. 347 late Monday, a bill which is being dubbed the Federal Restricted Buildings and Grounds Improvement Act of 2011. In the bill, Congress officially makes it illegal to trespass on the grounds of the White House, which, on the surface, seems not just harmless and necessary, but somewhat shocking that such a rule isn’t already on the books. The wording in the bill, however, extends to allow the government to go after much more than tourists that transverse the wrought iron White House fence.
Under the act, the government is also given the power to bring charges against Americans engaged in political protest anywhere in the country.

  • http://www.cnn.com/2012/02/28/opinion/sanders-gas-speculation/index.html Gas prices approaching $4 a gallon on average are causing severe economic pain for millions of Americans. Pump prices spiked 5% in the past month alone. Forget what you may have read about the laws of supply and demand. Oil and gas prices have almost nothing to do with economic fundamentals. But there's another reason for the wild rise in gas prices. The culprit is Wall Street. Speculators are raking in profits by gambling in the loosely regulated commodity markets for gas and oil.

  • Belgium hit by general strike as EU leaders meet Belgium is holding its first general strike in more than six years in protest over austerity measures, as EU leaders meet for a summit in Brussels. The main train station in Brussels was closed while flights at Belgium's low cost airport Charleroi were cancelled.

  • Occupy London: The End of the Beginning Not long after midnight this morning, bailiffs finally moved in to evict the tents at the Occupy camp at St Paul’s Cathedral. The message is obvious. The City of London does not want a permanent witness to its excesses on the verge of the London Stock Exchange. It is over four months now since the first mass meetings on those iconic steps. Perhaps it is fitting that the location is best known for the “Fidelity Fiduciary Bank” scene in Mary Poppins. Now the tour guides will have another story to tell.

...we in Occupy Merced were evicted from our camp last week, with some being cited for trespassing. We are very small and have no attorney's or funds to fight it. We will continue our G.A.'s at regular times on Wed. and Sat. We will be doing F29 @ the local Walmart next. We are becoming partner affiliated with MTA. Wish we could get David Cobb to come out this way to speak and even more, wish we were closer so we could see Chris Hedges!

In line with San Diego District Attorney Bonnie Dumanis’ self proclaimed ‘fierce fight’ against medical marijuana patients in San Diego, almost two years after his initial arrest, the second attempt to prosecute Benjamin Gasper, a legal medical marijuana patient is underway. Dumanis’ office days before trial was supposed to begin, brought in ‘new’ evidence in an attempt to pressure the defendant into taking a deal rather then going through with the trial. The ‘new’ evidence includes transcripts of text messages between Benjamin, other medical marijuana patients, his family, and friends.

Benjamin Gasper's trail has been postponed to allow the defense to respond to the new evidence. The next court date is March 19th at 9:30 in department 50 of San Diego Superior Court.

“The latest move from the prosecution makes it clear that Dumanis is willing to go to great lengths to persecute patients, including surveying their text messages, emails, and personal communications. This continued harassment and attack on the medical cannabis community must end” said Terrie Best, San Diego Americans for Safe Access Court Support Coordinator.

Please support Benjamin Gasper as he fights for his rights in court. Also, join the NOT Dumanis Facebook page to show your opposition to the Dumanis Reign of Terror. With Dumanis’ recent bid for San Diego Mayor, it is critical the community loudly voice their outrage for her antics against patients as well as strongly oppose her Mayoral bid.

POLICE COMPLAINTS

Have you been mistreated by the Police? Have your First Amendment rights been violated? Have you been arrested for nothing, only to have the charges "unfiled" but held over your head for up to a year?
  • NEW First read this document: http://www.2momslaw.com/police_misconduct.pdf
  • Make a Complaint: How to Make a Police Complaint
    • Use this form: Complaint Form
    • Forms also available in the lobby of City Hall.
    • Citizen's Review Board member says we do NOT need names & badge numbers. File the complaint & it's up to SDPD to determine who the officer was (But it is better if we have them, of course).
  • ALSO: By telephone or in writing to
    • SDPD Internal Affairs Unit, 1401 Broadway, MS 709, San Diego CA 92101, (619) 531-2801
    • Complaints made to the Citizens Review Board do not necessarily make it into the officers' personnel files
    • Read this: Making Police Compliants That Stick
  • Also, consider making a CLAIM against the city for your BOND money if charges were never filed. They have 45 days to reject the claim, then you file a lawsuit. It costs $400 to file unless you can claim low income.

Call for Witnesses:
Two occupiers are facing trial for criminal charges stemming from arrests at the Port Shut-down on December 12. Attorneys for Curtis Williams (aka Hex) and Bobby Uribe are looking for defense witnesses to dispute officer testimony and any photo or video footage of the arrests. If you witnessed Curtis's arrest, please contact attorney Laura Sheppard at lrsheppardlaw@gmail.com. If you witnessed Bobby's arrest, please contact attorney Adriane Bracciale at criminalandtrafficdefense@gmail.com.

    • If you can help compile the database from incoming emails, please let me know. It just takes a person who can carefully enter the data in to a web-based form.
  • Arrests At Balboa Theater 2012 Jan 11 -- This topic created to track arrests and progress fighting felony arrests at Balboa Theater
  • UPDATED Two items relevant to OSD mission were placed on the agenda of the City of San Diego Rules Committee. This committee is yet another example of a "do-nothing" committee because they hardly even treated the proposals as serious.

  • NEW TELL POLICE HOW THEY ARE DOING: Police host monthly meetings in the community to get feedback from community members.

  • Legal is asking: If you were at the South gate on the day of The Port Shut Down 12/12 and witnessed any of the arrests and are willing to testify...please contact HiAndrea on FB or haz_el_eyes@yahoo.com -- Tammy.
