  • 24 Jan 2012 - Important Citizens' Review Board of Police Practices at Pt. Loma Library. Very important meeting for us. Lots of time for public comment and to submit our complaints for them to process.

  • 26 Jan 2012 - (7p) Voices of a Peoples History event at San Diego City College - Saville Theater. This is the 100th anniversary of the San Diego Free Speech Fight, when city council prohibited soapbox oration centered at Fifth and E streets in the Stingaree District (Gaslamp). Prosecutors charged those arrested on felony charges of conspiracy, and police brutality was common. The Free Speech League sought to bring the cases up to jury trials to clog the system. There were an estimated 5,000 involved in one protest, with 41 arrested. The views of the Free Speech movement were similar to Occupy, on the wealth divide, worker’s rights and later on, First Amendment rights. The circumstances of the movement are echoed today. Vigilantes would take Wobblies trying to go south to San Diego off the trains.

Making Police Complaints that Stick
The only way to make sure that your complaint against a police officer gets into their personnel file is to make the complaint directly to Internal Affairs:

By telephone or in writing to * SDPD Internal Affairs Unit: * 1401 Broadway, MS 709, San Diego CA 92101 * (619) 531-2801 Complaints made to the Citizens Review Board do not make it into the officers' personnel files unless they are marked as "substantiated" after an investigation. This means that if you have no witnesses or other evidence to support your allegations against a police officer, the complaint will very likely have no effect on that officer. Even if they do make it into the officer's personnel file, it can take a lot longer to get there than a complaint made directly to Internal Affairs.

Citizen complaints against officers in their personnel files can aid in the defense of people who arrested by those officers in the future. Defense attorneys file what is called a Pitchess motion when they allege that an arresting officer has acted illegally in a way that is relevant to their client's defense. If they win the motion, and there are complaints in that officer's personnel file for the same unlawful behavior, they may call the people who made the complaints to testify against that officer(s).

If you were a victim of, or witnessed, unlawful police behavior such as, but not limited to: brutality, excessive force, unlawful detentions or arrests, prolonged detention (being held for too long under the circumstances), racism, theft, coerced confessions, violations of police protocols, or unlawful searches, please call or write Internal Affairs. If you call, be prepared for the officer on the other end to be dismissive, but if you are firm about them taking their complaint, they have to put it in the officer's personnel file and there is an automatic investigation. The Internal Affairs rep will also ask for witness contact information. After you make the complaint, there is a possibility that you will have the opportunity to testify against that officer(s) for the next five years, or possibly longer.

Two occupiers are facing trial for criminal charges stemming from arrests at the Port Shut-down on December 12. Attorneys for Curtis Williams (aka Hex) and Bobby Uribe are looking for defense witnesses to dispute officer testimony and any photo or video footage of the arrests. If you witnessed Curtis's arrest, please contact attorney Laura Sheppard at lrsheppardlaw@gmail.com. If you witnessed Bobby's arrest, please contact attorney Adriane Bracciale at criminalandtrafficdefense@gmail.com.

Court Support for Occupy Trials
Bobby Uribe is scheduled to stand trial on February 23 and would like support from fellow occupiers. The downtown criminal courthouse is located at 220 W. Broadway on the corner of Front and Broadway. Trial call is 9 am in Dept. 2, where the case will be sent out to a trial department. If you're there at 9, you can follow Bobby and his lawyer to the trial department after they are sent out; if you get there after 9, you can ask the bailiff where the Uribe case was sent. The trial is expected to last 3-4 days, depending on the length of witness testimony on both sides. The list will be notified if the trial date changes.

  • Republican National Committee Files Brief Seeking To Allow Corporate Funding Of Campaigns One of the few remaining limits on corporations’ power to buy and sell American elections is that corporations are not allowed to give money directly to federal candidates. Citizens United frees them to spend billions of dollars running ads or otherwise trying to change the result of an election to suit their interests, but corporations cutting checks directly to candidates or to political committees such as the Republican National Committee is one of the few things the Supreme Court’s conservatives have not yet imposed upon the country.

  • National Lawyers Guild Files FOIA Requests Seeking Evidence of Federal Role in Occupy Crackdown With Congress no longer performing its sworn role of defending the US Constitution, the National Lawyers Guild Mass Defense Committee and the Partnership for Civil Justice today filed requests under the Freedom of Information Act (FOIA) asking the Department of Justice, the Department of Homeland Security, the FBI, the CIA and the National Parks Service to release "all their information on the planning of the coordinated law enforcement crackdown on Occupy protest encampments in multiple cities over the course of recent days and weeks."

  • SFPD Pepper Spray Seminarian Filming Documentary at Occupy Wall Street West While filming the Occupy Wall Street peaceful protest for a documentary I am working on, I was pepper sprayed by SFPD without warning. I was immediately blinded, and because it was raining, the pepper spray kept running into my eyes from my hair keeping me blinded for nearly an hour. Protesters guided me to safety multiple times as the police apparently were surging at the crowd. They also secured my gear and secured it in my backpack. Street medics treated me and hustled me several blocks away to safety. Eventually I was able to open my eyes again and interviewed myself

    • It usually takes about 6 hours for someone who has been arrested to pop up here. This site will tell you their charges, bail, etc. Jail's number is (619) 615-2700. The jail won't tell you much if anything that is not on the website. Please check this website before saying someone is in or out of jail to avoid confusion.
