ATTEMPTED ARREST OF MAYOR SANDERS
- Project page: Snap Dragon -- All related documents are organized there.
Okay, so the cat is out of the bag. We were trying to catch Mayor Sanders in his office, since I had asked in writing to talk to him last week, and they told me that he was in town, and "his schedule is not flexible and is set for at least two months." And, if we were lucky, San Diego police officers would cooperate, and in my mind, actually think about what I was presenting to them. No, they did not allow me to talk to them at all, except to a lowest-level police officer that tried to fill out a citation form.
This action went very well, but was absolutely the most ballsy thing I have ever tried, in terms of direct confrontation. But we had our ducks in a row... every issue was tied off in the document. But still I was sapped of energy because recent pneumonia-like illness I had really left me out of shape.
I suggest you take a look at the video here:
http://www.copswiki.org/Common/M1228 -- (but it is not converted yet as I write this). My camera was running the whole time but I edited out all the walking from place to place, going through security, looking for the right office, etc. and kept only the reasonably good parts, but you might want to skip through it. (Thank you volunteers who ran this camera b/c I was tied up...)
My suggestion to all Occupies... this type of action gets the most traction of anything I have done. Watch local government closely. In no time they will screw up while you are watching, and then call them on it. If we had people "occupying" public meetings around the country, we could stop the crony capitalism we current watch helplessly occur.
TODAY (Tuesday) -- is the City Council meeting... We need to continue to attend these. Learn to be a better speaker by taking the opportunity at every meeting.
THANK YOU to everyone who came to help support this action... Would have been even better had we seen Sanders hauled off in handcuffs and left in jail for a few years.

Roberto Garcia
On Oct 28th around 8:30 pm I was standing on the sidewalk in the intersection between 3rd and B, on the east side of the Civic Center Plaza.
At the time the crowd got heated because the police officers where "closing" the plaza with barricades. There was an object that was thrown and hit one of the officer that was standing near the barricades.
An officer arrested me because I "looked suspicious." This is attributed to the fact that I had a gas mask around my neck. I was also wearing an orange shirt, with a jean jacket.
If there is anything that you can do to help me I would really appreciate it. If you need more details of the incident let me know.
email me I would really appreciate it: betorroque@gmail.com

- Members Of Occupy SD Attempt To Arrest Mayor Sanders About 20 members of Occupy San Diego tried to make a citizen's arrest of Mayor Jerry Sanders today, alleging that he committed embezzlement when he allowed the temporary name change of Qualcomm Stadium to "Snapdragon Stadium."
- Oakland Becomes the Epicenter for Journalist Arrests While most of the attention surrounding journalist arrests at Occupy protests has focused on New York City, where more than 20 journalists have been detained, it looks like Oakland will be giving the Big Apple a run for its money. On Jan. 28, Oakland police detained six journalists during mass arrests of Occupy protesters. This comes just weeks after Oakland police apprehended another journalist who, in a video of the arrest, appeared to be obeying orders to disperse.

- Where we meet, how to recover confiscated property from the San Diego Police Department, information for people were arrested, etc.
LEGAL
POLICE COMPLAINTS
- OSD speaks at the Citizens Review Board of Police Practices on 1/24
Have you been mistreated by the Police? Have your First Amendment rights been violated? Have you been arrested for nothing, only to have the charges "unfiled" but held over your head for up to a year?
- First read this document: http://www.2momslaw.com/police_misconduct.pdf
- Make a Complaint: How to Make a Police Complaint
- Use this form: Complaint Form
- Forms also available in the lobby of City Hall.
- Citizen's Review Board member says we do NOT need names & badge numbers. File the complaint & it's up to SDPD to determine who the officer was (But it is better if we have them, of course).
- ALSO: By telephone or in writing to
- SDPD Internal Affairs Unit, 1401 Broadway, MS 709, San Diego CA 92101, (619) 531-2801
- Complaints made to the Citizens Review Board do not necessarily make it into the officers' personnel files
- Read this: Making Police Compliants That Stick
- Also, consider making a CLAIM against the city for your BOND money if charges were never filed. They have 45 days to reject the claim, then you file a lawsuit. It costs $400 to file unless you can claim low income.
Call for Witnesses:
Two occupiers are facing trial for criminal charges stemming from arrests at the Port Shut-down on December 12. Attorneys for Curtis Williams (aka Hex) and Bobby Uribe are looking for defense witnesses to dispute officer testimony and any photo or video footage of the arrests. If you witnessed Curtis's arrest, please contact attorney Laura Sheppard at
lrsheppardlaw@gmail.com. If you witnessed Bobby's arrest, please contact attorney Adriane Bracciale at
criminalandtrafficdefense@gmail.com.
- Making Police Compliants That Stick -- Important info from Adriane of NLG
- Anyone with information about arrests... Please, we need to continue to compile a complete list.
- IF YOU HAVE BEEN ARRESTED, DETAINED, OR CITED... Please complete the form here: Occupy Legal Info Request and email to raylutz@citizensoversight.org.
- If you can help compile the database from incoming emails, please let me know. It just takes a person who can carefully enter the data in to a web-based form.
- Arrests At Balboa Theater 2012 Jan 11 -- This topic created to track arrests and progress fighting felony arrests at Balboa Theater
- Two items relevant to OSD mission were placed on the agenda of the City of San Diego Rules Committee. This committee is yet another example of a "do-nothing" committee because they hardly even treated the proposals as serious.
- TELL POLICE HOW THEY ARE DOING: Police host monthly meetings in the community to get feedback from community members.
- Legal is asking: If you were at the South gate on the day of The Port Shut Down 12/12 and witnessed any of the arrests and are willing to testify...please contact HiAndrea on FB or haz_el_eyes@yahoo.com -- Tammy.

- What to say to cops if you're busted. What you say and do can hurt you in court -- This is what I advise my clients to say when confronted by a law enforcement officer: "Officer, please understand I refuse to talk with you until I consult with my attorney. I also refuse to consent to any search of these premises or any other premises under my control, or in which I have a possessory, proprietary, or privacy interest, including my car, my body, or effects. I hereby demand to immediately be allowed the reasonable opportunity to obtain the advice of my attorney by telephone. from: http://layon.net/busted.php
- To check if someone is in jail check this website: http://apps.sdsheriff.net/wij/wij.aspx
- It usually takes about 6 hours for someone who has been arrested to pop up here. This site will tell you their charges, bail, etc. Jail's number is (619) 615-2700. The jail won't tell you much if anything that is not on the website. Please check this website before saying someone is in or out of jail to avoid confusion.
- FYI -- Penal Code 849.5. In any case in which a person is arrested and released and no accusatory pleading is filed charging him with an offense, any record of arrest of the person shall include a record of release. Thereafter, the arrest shall not be deemed an arrest, but a detention only.
